Viral Garden Terms of Service

By accessing or using Viral Garden, you agree to these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not access the service.

Viral Garden provides a web application for creating social media posts (photo carousels and short videos) and publishing them to TikTok, YouTube and Instagram accounts you connect. Viral Garden uses YouTube API Services to publish to YouTube channels you connect. The service may include:

• Post creation and editing capabilities
• TikTok integration, to publish posts to your TikTok account (on paid plans)
• YouTube integration, to publish videos (on paid plans)
• Instagram integration, to publish photo and carousel posts (on paid plans, for Instagram Business or Creator accounts)

To use Viral Garden, you must:

• Sign in with Google or with an email address and password
• Provide accurate account information
• Be responsible for maintaining account security
• Notify us of any unauthorized account usage

When using our platform integrations:

• You authorize Viral Garden to upload videos to your TikTok account
• You remain responsible for compliance with TikTok's Terms of Service
• You maintain ownership of all content uploaded through our service
• You can revoke TikTok access through Viral Garden settings or TikTok security settings at any time
• Connecting a YouTube channel requires a paid plan
• You authorize Viral Garden to upload videos to a YouTube channel you connect, both when you publish a post and when an automation you set up publishes on its schedule
• By connecting a YouTube channel you agree to be bound by the YouTube Terms of Service, and Google's use of your information is governed by the Google Privacy Policy
• You can revoke YouTube access by disconnecting the channel in Viral Garden, or at any time through the Google security settings page
• Connecting an Instagram account requires a paid plan and an Instagram Business or Creator account
• You authorize Viral Garden to publish photo and carousel posts to an Instagram account you connect, both when you publish a post and when an automation or scheduled post you set up publishes
• You remain responsible for following the Instagram Terms of Use and Community Guidelines
• You can revoke Instagram access by removing the account in Viral Garden, or by removing Viral Garden in Instagram's settings under Apps and websites

Viral Garden provides access to a library of "moodboard" images for use in slideshows and video creation. While Viral Garden holds the rights to these images and makes them available for use within the platform, the following terms apply:

• All moodboard images are provided on an "as is" basis without warranties of any kind
• By incorporating any moodboard images in your published content, you assume full and complete responsibility for such use
• You agree to indemnify, defend, and hold harmless Viral Garden, its owners, officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of these images
• Viral Garden bears no responsibility for any legal issues that may arise from your use of these images in your content
• You agree that any legal action, takedown notices, or intellectual property claims related to videos you create are solely your responsibility
• You agree not to redistribute, sell, license, or otherwise make available any moodboard images outside of videos created using the Viral Garden platform

Viral Garden reserves the right to remove access to any image at any time without notice or liability.

We reserve the right to:

• Modify or discontinue any feature without prior notice
• Make changes to the service at our discretion
• Consider user feedback regarding discontinued features

Regarding your data:

• We keep your account information and the content you create while your account is open; data from connected platforms is kept as described in the Privacy Policy
• Access tokens for connected accounts are encrypted at rest
• To delete your account, email support@viral.garden
• Our database is backed up daily and backups expire after 7 days

Usage of Viral Garden:

• Usage limits apply: your plan's credits and connected account allowance, and daily publishing limits such as a cap on YouTube uploads per day and Instagram's own daily publishing limit
• Account sharing is permitted
• Commercial use is allowed

Viral Garden is provided on an "as is" and "as available" basis. We assume no responsibility or liability for any service interruptions, downtime, or loss of data resulting from such interruptions. No monetary compensation is provided for service interruptions.

The Viral Garden name and logo are protected trademarks. Users retain all rights to their created content.

To the fullest extent permitted by law, Viral Garden and its owners, officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the service. You use Viral Garden at your own risk and assume full responsibility for any content you create, upload, or publish through the platform.

Any legal disputes shall be resolved in Phoenix, Arizona, United States. Claims must be filed within 24 hours of the incident in question.

While we do not enforce strict age restrictions, users under 13 years old should have parental consent.

We reserve the right to modify these Terms at any time.
